Terms of Service

These Terms of Service ("Terms") govern your use of the DirektLabel mobile application (the "App") on iOS and Android. By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Description of Service

DirektLabel lets you photograph a food product's ingredient label and receive an analysis of how processed that product is, expressed as a score from 1 to 10 and a band derived from the NOVA food classification system. The App provides:

• Reading of ingredient labels from a photo, performed by a third-party AI service via our servers
• A rule-based processing classification and score computed on your device
• Identification of ultra-processing markers, added nutrients, and declared allergens
• Scan history stored locally on your device
• Optional premium features through a paid subscription

An internet connection is required to analyze a label. The App is a reference tool, not a nutrition, medical, or safety service.

2. Eligibility and Accounts

You must be at least 13 years old to use DirektLabel. By using the App you represent that you meet this requirement.

DirektLabel does not offer user accounts. The App creates an anonymous identifier so that usage limits can be enforced; you are responsible for the security of your own device and any data stored in the App.

3. Free and Premium Services

3.1 Free Tier

The free version of DirektLabel includes:

• Up to 5 label scans per day, counted on our servers and reset at midnight UTC
• A scan history of up to 10 saved scans
• The complete analysis on every scan
• Advertising supplied by third parties

3.2 DirektLabel Pro

DirektLabel Pro is an auto-renewing subscription that includes:

• Unlimited daily scans, subject to the fair-use provision in Section 3.5
• Unlimited scan history
• An ad-free experience
• A personal statistics dashboard
• Achievements and insights
• Side-by-side product comparison
• Custom ingredient alerts

3.3 Subscription Terms

• Pro is offered as a monthly or annual subscription. Prices are displayed in the App in your local currency before purchase and may vary by region.
• Purchases are processed by the Apple App Store on iOS or Google Play on Android. Payment is charged to the store account you use to confirm the purchase.
• Subscriptions renew automatically at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of that period.
• You can manage or cancel a subscription in your Apple Account subscription settings or your Google Play subscription settings. Cancelling stops future renewals; access continues until the end of the paid period.
• A subscription purchased on one platform is valid only on that platform and cannot be transferred between Apple and Google.
• Refunds are governed by the policies of Apple or Google, as applicable. We are not able to issue refunds for store-processed purchases, and no refunds are offered for partial periods except where required by law.

3.4 Changes to Tiers and Pricing

We may change the features included in the free or Pro tiers, or the price of a subscription. Where a price change affects an existing subscription, the applicable store will notify you and seek any consent required before the change takes effect.

3.5 Fair Use

"Unlimited" scanning is intended for ordinary personal use. We operate server-side rate limits to protect the service and may throttle, suspend, or terminate access that is automated, abusive, or materially outside normal individual use.

4. Acceptable Use

You agree to use DirektLabel only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any copyright or proprietary notices
• Use automated systems or software to extract data from the App or our API
• Circumvent, disable, or interfere with usage limits, app-integrity checks, or any other security feature
• Interfere with or disrupt the App's servers or networks
• Attempt to gain unauthorized access to any portion of the App or our backend
• Use the App to transmit any malware, viruses, or harmful code

5. Intellectual Property

The App and its original content, features, and functionality — including the classification rule set and the presentation of results — are owned by DirektLabel and protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App or its content without our express written permission. NOVA is a food classification system developed by researchers at the University of São Paulo; DirektLabel is not affiliated with or endorsed by them.

You retain ownership of the photographs you capture. You grant us a limited licence to process an image solely to produce your analysis, as described in the Privacy Policy.

6. Important Disclaimers

6.1 Not Medical or Nutritional Advice

IMPORTANT: DirektLabel does NOT provide medical, nutritional, or dietary advice. The App reports how processed a product's ingredient list is, for informational and educational purposes only. Its scores and analysis are not a substitute for professional medical advice, diagnosis, or treatment.

• Always consult a qualified healthcare provider before making dietary changes
• The App does not diagnose, treat, cure, or prevent any disease or health condition
• A processing score is not a measure of nutritional value, and it is not a safety judgment. A minimally processed food can still be high in sugar, salt, or fat
• No ingredient identified by the App should be read as a claim that it is harmful
• Individual dietary needs vary based on health conditions, allergies, and other factors

6.2 Accuracy of Information

The classification step is rule-based and deterministic, but the reading step relies on a third-party AI service and can make mistakes. We cannot guarantee that:

• Text recognition will be accurate or complete
• Every ingredient will be correctly identified, translated, or classified
• Every ingredient on the package will be captured, particularly on curved, damaged, or partially photographed labels
• Ingredient information reflects the current formulation of a product

Always verify ingredient information directly on the product packaging, especially if you have food allergies or sensitivities.

6.3 Allergen Warning

DirektLabel is NOT a reliable tool for allergen detection. Allergens shown in the App are surfaced for awareness only and do not affect scoring. The App must never be your primary method of allergen identification. Always read product labels carefully and contact manufacturers if you have food allergies.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIREKTLABEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Personal injury or health issues
• Allergic reactions or adverse health effects
• Errors in ingredient scanning, translation, or analysis
• Service interruptions or data loss

Our total liability for any claims arising from your use of the App shall not exceed the greater of the amount you paid us for the App in the twelve (12) months preceding the claim, or twenty US dollars ($20).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

9. Indemnification

You agree to indemnify, defend, and hold harmless DirektLabel and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any dietary or health decisions you make based on information from the App

10. Third-Party Services

The App relies on the following third-party services, and your use of the App is subject to their terms in addition to ours:

• Supabase — backend hosting and the API relay through which scans are processed
• Google Gemini API — reading and identifying ingredients from label photographs
• Apple App Store / Google Play billing — subscription purchase and validation
• Apple App Attest and Google Play Integrity — verification that the app installation is genuine
• Google AdMob — advertising shown to free users

We are not responsible for the content, availability, privacy practices, or terms of any third-party service.

11. Apple-Specific Terms

The following applies to the App obtained through the Apple App Store:

• These Terms are between you and DirektLabel only, not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to furnish any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability, regulatory non-compliance, or consumer protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time.

We may revise these Terms. We will notify users of material changes by posting the updated Terms in the App or on this website and revising the "Last updated" date. Continued use of the App after such changes constitutes acceptance of the revised Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, if you materially breach these Terms or where required by law.

Upon termination:

• Your right to use the App immediately ceases
• You should delete the App from your device
• Any refund for an active subscription is governed by the applicable store's policy

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration under the rules of the American Arbitration Association, seated in King County, Washington, except that either party may seek injunctive relief in a court of competent jurisdiction, and either party may bring an individual claim in small-claims court. Where arbitration does not apply, you and DirektLabel consent to the exclusive jurisdiction of the state and federal courts located in King County, Washington.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings in your local courts or guarantees consumer protections that cannot be waived by contract, nothing in this section removes those rights.

15. Severability

If any provision of these Terms is found unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DirektLabel regarding your use of the App and supersede any prior agreements.
